Exactly this. I doubt anyone in Yellowcard is seriously hurting for money (they started this before Covid so Covid isn't an excuse) and the continuation just seems so tacky and disgusting. It's a weird look to try and make money off of a black person (full stop, but also) who is dead and cannot defend themselves or have a say in the matter.
Right like at the end of the day him being dead and unable to say anything either way is enough reason to drop it it actually makes me sick that they didn’t makes it hard to call them my favorite band
Yeah this is pretty fucking uncool, not gonna lie that it’s (probably permanently) altered the way I view the band
If this is the case I would really hope that they would come out and say something eventually (when/if they can). This truly sucks.
I looked up their statement from December when they first said they weren't dropping the case Yellowcard feels "incredible mixed emotions" over continuing with Juice WRLD suit, says law firm - Music News - ABC News Radio Glad they have mixed emotions about it but you are making the wrong call. Would have been nice to see even 1 or 2 of them drop from the case at least. I think it's weird that Capitol records is never mentioned in the lawsuit as I was hoping maybe the label was pushing? But it appears Yellowcard owns the copyright to the songs as well as the right to defend it.
This whole thing remains so bizarre to me. I really can't fathom thinking this is the right thing to do, and like someone said, has also altered the way I view the band.
Right thing to do? Other more noteworthy and financially successful bands like Tom Petty and The Rolling Stones fuller suits. Why treat Yellowcard any different?
Morality? I am pretty sure the complaint was filed over stolen music. People don’t have to like it. The life circumstances of the artists involved don’t dictate whether he used a melody or not. As I said, I am fan of bands paying tribute to other artists, but I could understand why a band could get upset.
I'd say there is little proof the melody was even lifted from them. It's a really simple melody and only portions of the song are similar.
I think the point is that the *law* may potentially consider it "stealing", but the average person really wouldn't see it that way. They don't sound alike at all unless you're really looking for it imo. Morally, it's exploiting a problem with our laws. Regardless of whether or not its legal, it's still morally questionable Assuming that all laws and judgements made in court are "moral" is an odd take from my perspective
Which is a totally fair argument. From what I remember reading, he may have some knowledge of the Yellowcard or genre of music. It could be a coincidence, or a tribute. I actually personally think it’s cool to use Yellowcard as an influence in Hip Hop. I had never heard of Juice Wrld before, but I don’t think a suit is required. It’s not our call though. They do have a right to take it to court to figure out and win or lose. It doesn’t seem like a malicious suit though. I don’t want bands to stop using their influences though. It may teach people to get permission or tread lightly or something. Maybe Yellowcard will settle and get a writing credit in the song and just donate the settlement earning to Juice World’s Mom’s Fund to help kids struggling with addiction.
There’s nothing to “figure out” in court when the person who wrote the fucking song is dead it’s literally all hearsay and guesses at that point
For those interested in what their claims are, you can read about them starting at entry 85. https://www.musicbusinessworldwide.com/files/2019/10/BuschvsJuice.pdf
Personally I stopped reading right around here, give or take a few words 72. Specifically, in a published interview, Defendant Juice WRLD stated that he had a crush on a girl in fifth grade who was “really Emo.” At the time, the girl mentioned that she really enjoyed Emo pop rock, which is the precise genre of “Yellowcard’s” music. Defendant Juice WRLD stated that he went home and listened to that music.
