Tiers are based on usage. UUBL pokemon are pokemon that aren't used enough in OU to be considered OU, but they are considered too good for UU.
I think OU has a threshold of usage that has to be met and those Pokemon don't meet that threshold but also are too good to be allowed in UU. Edit: I was too slow
Also, full disclosure, are you using your GMax? If you want to battle without them I can use someone else. If you want to include them, I'm all for it.
