Absolutely nothing that he was going through can make it justifiable

 

Why did we bring this guy to this thread? Attempted murder is attempted murder. His band mates can forgive him, you can forgive him, whatever, that doesn’t make him worthy of a platform!

It's Metalsucks. They're on par with TMZ for posting clickbait so I doubt they'll stop posting about AILD and Varg as long as it brings the clicks.

cmoney - Not tagging or quoting you at your request, but dear God, those are some horrendous takes tonight. It should just boil down to basic human decency. You try to arrange a hit for your wife and kidnap your kids - you sort of lose the right to respect and the right to pursue a platform for your art commercially. He could have divorced his wife and arranged a custody agreement like a normal person, and we wouldn't be in this situation.

 

At least twice a month I come back to a thread and see some unspeakable shit has gone down. It's kind tiring.

 

Also, I unfortunately am related to someone on the other side of this. My cousin's dad killed her sister. He seemed like a normal person and you'd never know he was messed up. His new wife broke up with him and wanted to deny him access to their very young child, so he killed his youngest daughter and took his own life via gas.

Absolutely fuck anyone defending a murderer. Even if they are related, or best friends, or anything. Fuck them and fuck Tim Lambesis. You don't get to defend someone no matter what connection you have, let alone because you kinda like their band.

This entire conversation is... heavy sigh. The man literally plead guilty and went to jail and folks will still say "we don't know what really happened" or "imagine what he was going through" because some dude's music is more important than an actual human woman's life. This is what I mean when I say the non-legal "burden of proof" is a moving target that no survivor can ever hit because some people could actually witness the act and still say it wasn't proof enough.

THAT is the message sent to every domestic violence survivor out there with takes like cmoney whatever's - and although it's not the type I personally survived, I'd say being married to someone who actually tried to have you murdered is about as domestically violent as it gets.

Also sending love and light to anyone who was upset, hurt or triggered by reading this crap. You're not alone.

(Triggered, as in the medical term for the symptom of PTSD. Since that needs to be said these days.)

I hate the “he served his time” bullshit too because he didn’t even serve his full sentence.

 

Criminal lawyer here. And I know that this topic has come up before, so I wanted to clarify: He absolutely served his sentence. The media just does a shitty job reporting how criminal law and sentencing work.

This is the norm across the country. It’s the result of mass over incarceration and a pattern of disproportionate criminal sentences.

Here in Illinois, the vast majority of all prison terms are, essentially, 50% terms. What this guy did would have fallen in that category here as well.

Only the absolute worst of the worst get bumped up to 85%. And then straight first degree murder is 100%. But that’s basically it.

And this is all known, and part of the calculus, when the defendant is sentenced.

In short, it really isn’t fair to say he didn’t serve his full time. He served what he was always required to serve. The “full” term reported in the media is only something he has to serve if he fucks up royally while in prison. But that’s true of every human being sentenced to a prison term.

This guy sucks. Don’t support him or his band. But I don’t think his only serving the required 50% term is a dark mark in his ledger.

It’s pretty fucked at every stage.

The laws are often outdated, ill fitting, or straight garbage. The enforcement is, obviously, permanently marred by systemic problems. The prosecution is often perfunctory or mechanical. Sentencing is just arbitrary and, often, oppressive.

And then there is the incarceration, which is basically barbaric.

 

Truly though, didn't this all just unfold like... 5 years ago? How is a man who tried to have his wife murdered already out of prison? Whether he served 50% or 100% of his sentence... how is that all his sentence was? This isn't even a reasonable amount of time for his ex-wife to feel safe again.

 

In California, solicitation carries a penalty of between 3-9 years. He plead guilty, which means he got a little leniency for avoiding the time and pain of a trial.

His sentence was 6 years.
