I don't understand the Will Smith quote, how did Sean Penn go to jail because of Will Smith?

 

I think he's trying to say "I went to jail for assault, will smith did the same thing I did so why didn't he?"

 

I think Penn is implying that Smith didn't serve any jail time for a physical assault meanwhile Penn has served time. Keep in mind Chris Rock didn't want to press charges against Smith.
