got it, i legitimately wasnt sure but it makes sense that since youre already an existing employee with said benefits, it would be shitty to prevent you from being in a position to use them. i was strictly thinking about a new hire off the street who does not, presently, have access to said benefits. still shitty!!!

 

It's also illegal to make hiring decisions for new-hires based off things like family planning. It's just impossible to prove.

i’m sure it would just be “we based it off of qualifications” which is a nebulous thing difficult to prove. they could argue that while i’ve been here longer than the person they hired, we have the same title and thus are equally qualified. which is just plainly bullshit but probably in legalese “correct”

 

I seriously considered bringing a lawsuit against a company I worked for for denying me benefits. They had just rolled out a new paternity leave and i was the first in the company to try them out, and as i put in the paperwork they then put out an addendum to the policy with new limits and qualifications that suddenly disqualified me. Super shitty behavior.
